Act of Congress began its professional life as a bluegrass/folk trio formed in April 2006 by guitarist Brad McConnell, Chris Griffin on guitar and dobro, and Adam Wright on mandolin and guitar.

According to Griffin, the band's name, which McConnell created, reflects what it took to get the three musicians together. The band's first performance was at The Winery in Clanton, followed by a performance at Coffee on Valley. In July, the band opened for the well-regarded Greencards. In 2008 the band performed at City Stages.
